ALLEGED BREACHES OF CERTAIN INTERNATIONAL OBLIGATIONS IN RESPECT OF THE OCCUPIED PALESTINIAN TERRITORY
(NICARAGUA v. GERMANY)
ORDER
The President of the International Court of Justice,
Having regard to Article 48 of the Statute of the Court and to Article 79bis, paragraphs 1 and 3, of the Rules of Court,
Having regard to the Application filed in the Registry of the Court on 1 March 2024, whereby the Republic of Nicaragua (hereinafter “Nicaragua”) instituted proceedings against the Federal Republic of Germany (hereinafter “Germany”) concerning alleged breaches of international obligations in respect of the Occupied Palestinian Territory,
Having regard to the Order of 19 July 2024, whereby the Court fixed 21 July 2025 and 21 July 2026 as the respective time-limits for the filing of the Memorial of Nicaragua and the Counter-Memorial of Germany,
Having regard to the Memorial of Nicaragua filed on 21 July 2025 within the time-limit thus fixed;
Whereas, on 21 October 2025, Germany filed preliminary objections to the jurisdiction of the Court and to the admissibility of the claims contained in paragraph 484, subparagraphs (1) to (9), of Nicaragua’s Memorial, and whereas an original copy of those preliminary objections was immediately transmitted to the other Party;
Whereas, accordingly, by virtue of Article 79bis, paragraph 3, of the Rules of Court, the proceedings on the merits are suspended and a time-limit has to be fixed for the presentation by the other Party of a written statement of its observations and submissions on the preliminary objections;
Taking account of Practice Direction V, pursuant to which the time-limit for the presentation of such a written statement shall generally not exceed four months from the date of the filing of the preliminary objections,
Fixes 23 February 2026 as the time-limit within which the Republic of Nicaragua may present a written statement of its observations and submissions on the preliminary objections raised by the Federal Republic of Germany; and
Reserves the subsequent procedure for further decision.
Done in English and in French, the English text being authoritative, at the Peace Palace, The Hague, this twenty-second day of October, two thousand and twenty-five, in three copies, one of which will be placed in the archives of the Court and the others transmitted to the Government of the Republic of Nicaragua and to the Government of the Federal Republic of Germany, respectively.
