AND\/OR BY THE LEAGUE OF ARAB STATES <\/p><\/div>\n

\n

Report of the Sixth Committee<\/u><\/p><\/div>\n

I. INTRODUCTION<\/p><\/div>\n

\n

1.\t<\/span>The item entitled “Observer status of national liberation movements recognized by the Organization of African Unity and\/or by the League of Arab States” was included in the provisional agenda for the forty-third session pursuant to paragraph 3 of General Assembly resolution 41\/71 of 3 December 1986. <\/p><\/div>\n

\n

2.\t<\/span>At its 3rd plenary meeting, on 23 September 1988, the General Assembly, on the recommendation of the General Committee, decided to include the item in its agenda and to allocate it to the Sixth Committee. <\/p><\/div>\n

\n

3.\t<\/span>In connection with the item, the Committee had before it a report of the Secretary-General (<\/span>A\/43\/528<\/a> and Add.<\/span>1 <\/a>and <\/span>2<\/a>) containing the views presented by<\/span> <\/span>Member States pursuant to paragraph 3 of resolution 41\/71.<\/span><\/p><\/div>\n

\n

4.\t<\/span>The Committee considered the item at its 21st, 22nd and 50th meetings, on 24 and 26 October and 28 November. The summary records of those meetings contain the views of the representatives who spoke during the consideration of the item (A\/C.6\/43\/SR.21, 22 and 50). <\/p><\/div>\n

II. CONSIDERATION OF PROPOSALS <\/p><\/div>\n

\n

A. Draft resolution A\/C.6\/43\/L.10 and Rev.1<\/u> <\/p><\/div>\n

\n

5.\t<\/span>The Committee had before it a draft resolution (A\/C.6\/43\/L.10) entitled “Observer status of national liberation movements recognized by the Organization of  African Unity and\/or by the League of Arab States” sponsored by Algeria, Bahrain, Democratic Yemen, Djibouti, Iraq, Jordan, Kuwait, Lebanon<\/u>, the Libyan Arab <\/u>Jamahiriya, Mauritania, Morocco, Oman, Qatar, Saudi Arabia, Somalia<\/u>, the Sudan<\/u>, the Syrian Arab Republic, Tunisia<\/u>, the United Arab Emirates, Yemen and Zambia<\/u>.  The draft resolution read as follows:<\/p><\/div>\n

\n\t\t\t\t\t<\/span>“The General Assembly<\/u>,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“Recalling<\/u> its resolutions 35\/167 of 15 December 1980, 37\/104 of 16 December 1982, 39\/76 of 13 December 1984 and 41\/71 of 3 December 1986,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“Taking note<\/u> of the report of the Secretary-General,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“Recalling<\/u> its resolution 3237 of 22 November 1974 granting observer status to the Palestine Liberation Organization,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“Recalling further<\/u> its resolution 31\/152 of 20 December 1976 granting observer status to South West Africa People’s Organization,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“Desirous<\/u> of enhancing the effective role played by these national liberation movements,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“Bearing<\/u> in mind<\/u> the necessity of facilitating the work of these organizations,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“1.\t<\/span>Decides<\/u> that these organizations are entitled to have their communications relating to the sessions and work of the General Assembly directly, and without intermediary, issued and circulated as official documents of the General Assembly;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“2.\t<\/span>Decides also<\/u> that the above organizations are entitled to have their communications relating to the sessions and work of all international conferences convened under the auspices of the General Assembly directly, and without intermediary, issued and circulated as official documents of these conferences;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“3.\t<\/span>Considers<\/u> that the above organizations are entitled to have their communications relating to the sessions and work of all other organs of the United Nations as well as the conferences convened under their auspices directly, and without intermediary, issued and circulated as official documents of these conferences;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>“4.\t<\/span>Requests<\/u> the Secretary-General to take the necessary steps for the implementation of the present resolution.”\n\t\t\t\t<\/div>\n

6.\t<\/span>At the 50th meeting, on 28 November 1988, the representative of Jordan,  introduced a revised draft resolution (A\/C.6\/43\/L.10\/Rev.1) sponsored by Algeria, Bahrain, Democratic Yemen, Djibouti, Iraq, Jordan, Kuwait, Lebanon<\/u>, the Libyan Arab Jamahiriya, Mauritania, Morocco, Oman, Qatar, Saudi Arabia, Somalia<\/u>, the Sudan<\/u>, the Syrian Arab Republic, Tunisia<\/u>, the United Arab Emirates, Yemen and Zambia<\/u>, later joined by Afghanistan, Bangladesh and Cuba. The representative of Jordan also orally revised operative paragraph 3, by adding the word "appropriate" before the word "symbol".<\/p><\/div>\n

\n

7.\t<\/span>Draft resolution A\/C.6\/43\/L.10\/Rev.1 as orally revised was adopted by a vote of 81 to 2, with 25 abstentions (see para. 12, draft resolution A). <\/p><\/div>\n

\n

8.\t<\/span>Statements in explanation of vote before the vote were made by the representatives of the United States of America, Greece (on behalf of the twelve member States of the European Community), Israel and Canada. Statements in explanation of vote after the vote were made by the representatives of Japan, Argentina, Uruguay, Brazil, Sweden (on behalf of the Nordic countries), Thailand, Zaire, Turkey and Austria. <\/p><\/div>\n

B. Draft resolution A\/C.6\/43\/L.24 and Corr.1<\/u><\/p><\/div>\n

\n

9.\t<\/span>At the same meeting, the representative of Cuba introduced a draft resolution (A\/C.6\/43\/L.24 and Corr.1) sponsored by Afghanistan, Algeria, Angola, Bahrain, Bangladesh, Cuba, Democratic Yemen, Djibouti, Iraq, Kuwait, Lebanon<\/u>, the Libyan Arab Jamahiriya, Madagascar, Mauritania, Nicaragua, Oman, Qatar, Saudi Arabia, Somalia<\/u>, the Sudan<\/u>, the Syrian Arab Republic<\/u>, Tunisia, Uganda<\/u>, the United Arab Emirates<\/u>, Yemen and Yugoslavia<\/u>.<\/p><\/div>\n

\n

10.\t<\/span>Draft resolution A\/C.6\/43\/L.24 and Corr.1 was adopted by a vote of 87 to 9, with 14 abstentions (see para. 12, draft resolution B). <\/p><\/div>\n

\n

11.\t<\/span>A statement in explanation of vote before the vote was made by the representative of Israel. Statements in explanation of vote after the vote were made by the representatives of Japan, Turkey, France, Belgium, Italy, Thailand and the United States of America. <\/p><\/div>\n

XI.  RECOMMENDATIONS OF THE SIXTH COMMITTEE <\/p><\/div>\n

\n

12.\t<\/span>The Sixth Committee recommends to the General Assembly the adoption of the following draft resolutions: <\/p><\/div>\n

Observer status of national liberation movements recognized<\/u><\/p><\/div>\n

by the Organization of African Unity and\/or by the League<\/u><\/p><\/div>\n

\n\t\t\t\t\t<\/span>The General Assembly<\/u>,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Recalling<\/u> its resolutions 35\/167 of 15 December 1980, 37\/104 of 16 December 1982, 39\/76 of 13 December 1984 and 41\/71 of 3 December 1986,\n\t\t\t\t<\/div>\n

\n\t\t\t\t\t<\/span>1.\t<\/span>Decides<\/u> that the Palestine Liberation Organization and the South West Africa People’s Organization are entitled to have their communications relating to the sessions and work of the General Assembly directly, and without intermediary, issued and circulated as official documents of the General Assembly;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>2.\t<\/span>Decides also<\/u> that the Palestine Liberation Organization and the South West Africa People’s Organization are entitled to have their communications relating to the sessions and work of all international conferences convened under the auspices of the General Assembly of the United Nations directly, and without intermediary, issued and circulated as official documents of these conferences;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>3.\t<\/span>Authorizes<\/u> the Secretariat to issue and circulate as official documents of the United Nations under the appropriate symbol of other organs or conferences of the United Nations, communications submitted directly, without intermediary, by the Palestine Liberation Organization and the South West Africa People’s Organization, on matters relative to the work of these organs and conferences;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>4.\t<\/span>Requests <\/u>the Secretary-General to take the necessary steps for the implementation of the present resolution.\n\t\t\t\t<\/div>\n

\n\t\t\t\t\t<\/span>The General Assembly<\/u>,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Recalling<\/u> its resolutions 35\/167 of 15 December 1980, 37\/104 of 16 December 1982, 39\/76 of 13 December 1984 and 41\/71 of 3 December 1986,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Recalling also<\/u> its resolutions 3237 (XXIX) of 22 November 1974,  3280 (XXIX) of 10 December 1974 and 31\/152 of 20 December 1976,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Taking note<\/u> of the report of the Secretary-General, 2<\/u>\/\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Bearing in mind<\/u> the resolution of the United Nations Conference on the Representation of States in Their Relations with International Organizations relating to the observer status of national liberation movements recognized by the Organization of African Unity and\/or by the League of Arab States, 3<\/u>\/\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Noting<\/u> that the Vienna Convention on the Representation of States in Their Relations with International Organizations of a Universal Character, of 14 March 1975, 4<\/u>\/ regulates only the representation of States in their relations with international organizations,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Taking into account<\/u> the current practice of inviting the above-mentioned national liberation movements to participate as observers in the sessions of the General Assembly, specialized agencies and other organizations of the United Nations system and in the work of the conferences held under the auspices of such international organizations,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Convinced<\/u> that the participation of the national liberation movements referred to above in the work of international organizations helps to strengthen international peace and co-operation,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Desirous<\/u> of ensuring the effective participation of the above-mentioned national liberation movements as observers in the work of the international organizations and of regulating, to that end, their status and the facilities, privileges and immunities necessary for the performance of their functions,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>Noting<\/u> that many States have recognized those national liberation movements and have granted them in their countries facilities, privileges and immunities,\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>1.\t<\/span>Urges<\/u> all States that have not done so, in particular, those which are hosts to international organizations or to conferences convened by, or held under the auspices of, international organizations of a universal character, to consider as soon as possible the question of ratifying, or acceding to, the Vienna Convention on the Representation of States in Their Relations with International Organizations of a Universal Character;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>2.\t<\/span>Calls once more upon<\/u> the States concerned to accord to the delegations of the national liberation movements recognized by the Organization of African Unity and\/or by the League of Arab States and accorded observer status by international organizations, the facilities, privileges and immunities necessary for the performance of their functions, in accordance with the provisions of the Vienna Convention on the Representation of States in Their Relations with International Organizations of a Universal Characters;\n\t\t\t\t<\/div>\n
\n\t\t\t\t\t<\/span>3.\t<\/span>Requests<\/u> the Secretary-General to report to the General Assembly at its forty-fifth session on the implementation of the present resolution.\n\t\t\t\t<\/div>\n
