 I.   Introduction<\/strong><\/p><\/div>\n

 <\/strong><\/p><\/div>\n

1.   At its 17th plenary meeting, on 20 September 2005, the General Assembly, on the recommendation of the General Committee, decided to include in the agenda of its sixtieth session the item entitled “United Nations Relief and Works Agency for Palestine Refugees in the Near East” and to allocate it to the Special Political and Decolonization Committee (Fourth Committee). <\/p><\/div>\n

\n

2.   The Fourth Committee considered the item at its 20th, 21st, 24th and 25th meetings, on 1, 2, 10 and 14 November 2005. The Committee held a general debate on the item at its 20th and 21st meetings, on 1 and 2 November, and took action on the item at its 25th meeting, on 14 November (see A\/C.4\/60\/SR. 20, 21, 24 and 25). <\/p><\/div>\n

\n

3.   For its consideration of the item, the Committee had before it the following documents: <\/p><\/div>\n

 (a)   Report of the Commissioner-General of the United Nations Relief and Works Agency for Palestine Refugees in the Near East for the period from 1 July 2004 to 30 June 2005; <\/span>1<\/u><\/sup><\/a> <\/span><\/p><\/div>\n

 (b)   Report of the Working Group on the Financing of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (A\/60\/439); <\/p><\/div>\n

\n

 (c)   Report of the Secretary-General submitted in pursuance of General Assembly resolution 59\/118 on persons displaced as a result of the June 1967 and subsequent hostilities (A\/60\/212); <\/p><\/div>\n

\n

 (d)   Report of the Secretary-General submitted in pursuance of General Assembly resolution 59\/120 on Palestine refugees’ properties and their revenues (A\/60\/256); <\/p><\/div>\n

 (e)   Note by the Secretary-General transmitting the fifty-ninth report of the United Nations Conciliation Commission for Palestine, in accordance with paragraph 6 of General Assembly resolution 512 (VI) and paragraph 2 of General Assembly resolution 59\/117 (A\/60\/277); <\/p><\/div>\n

 (g)   Letter dated 7 November 2005 from the Permanent Representative of Israel to the United Nations addressed to the Chairman of the Special Political and Decolonization Committee (Fourth Committee) (A\/C.4\/60\/6). <\/p><\/div>\n

4.   At its 20th meeting, on 1 November, the Committee heard a statement by the Commissioner-General of the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), who introduced her report (see A\/C.4\/60\/SR.20). <\/p><\/div>\n

\n

5.   At the same meeting, the representative of Norway, in his capacity as Rapporteur of the Working Group on the Financing of UNRWA, introduced the report of the Working Group (see A\/C.4\/60\/SR.20). <\/p><\/div>\n

\n

6.   Also at the same meeting, the Committee held an interactive dialogue with the Commissioner-General on the item (see A\/C.4\/60\/SR.20). <\/p><\/div>\n

\n

7.   Also at the same meeting, the representative of the Permanent Observer Mission of Palestine to the United Nations made a statement (see A\/C.4\/60\/SR.20). <\/p><\/div>\n

 II.   Consideration of proposals<\/strong><\/p><\/div>\n

8.   At its 24th meeting, on 10 November, the Committee decided to defer taking action on the draft resolutions and one draft decision submitted under item 30 until its 25th meeting, on 14 November. <\/p><\/div>\n

 A.   Draft resolution A\/C.4\/60\/L.9<\/strong><\/p><\/div>\n

9.   At the 24th meeting, on 10 November, the representative of Indonesia, on behalf of Algeria, Bahrain, Bangladesh, Comoros, Djibouti, Egypt, Guinea, Indonesia, Iraq, Jordan, Kuwait, Lebanon, Malaysia, Morocco, Namibia, Oman, Qatar, Saudi Arabia, Senegal, Somalia, South Africa, the Sudan, Tunisia, the United Arab Emirates, Yemen and Palestine, introduced a draft resolution entitled “Assistance to Palestine refugees” (A\/C.4\/60\/L.9). Subsequently, Austria, Belgium, Bulgaria, Cuba, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Mali, Malta, Mauritania, the Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland and the United Kingdom of Great Britain and Northern Ireland joined in sponsoring the draft resolution. <\/p><\/div>\n

10.   At its 25th meeting, on 14 November, the Committee adopted draft resolution A\/C.4\/60\/L.9 by a recorded vote of 151 to 1, with 8 abstentions (see para. 22, draft resolution I). The voting was as follows: <\/span>2<\/u><\/sup><\/a> <\/span><\/p><\/div>\n

Subsequently, Cuba, Mali and Mauritania joined in sponsoring the draft resolution. <\/p><\/div>\n

14.   At its 25th meeting, on 14 November, the Committee had before it a revised draft resolution (A\/C.4\/60\/L.11\/Rev.1), submitted by the sponsors of draft resolution A\/C.4\/60\/L.11, which contained the following changes: <\/p><\/div>\n

\n

 (a)   In the eleventh preambular paragraph, the words “Aware of the continuing efforts” were replaced by the words “Aware of the extraordinary efforts”; <\/p><\/div>\n

\n

 (b)   In the seventeenth preambular paragraph, the words “including its education” were replaced by the words “notably its education”. <\/p><\/div>\n

\n

15.   At the same meeting, the Committee adopted draft resolution A\/C.4\/60\/L.11\/Rev.1 by a recorded vote of 152 to 6, with 2 abstentions (see para. 22, draft resolution III). The voting was as follows: <\/span>3<\/u><\/sup><\/a><\/p><\/div>\n

18.   At its 24th meeting, on 10 November, the Committee had before it a draft decision submitted by the Chairman, entitled “Increase in the membership of the Advisory Commission on the United Nations Relief and Works Agency for Palestine Refugees in the Near East” (A\/C.4\/60\/L.18). <\/p><\/div>\n

\n

19.   At its 25th meeting, on 14 November 2005, the Committee had before it revised draft decision A\/C.4\/60\/L.18\/Rev.1, submitted by the Chairman, which contained the following changes: <\/p><\/div>\n

\n

 (a)  The last sentence of subparagraph (b), which read: <\/p><\/div>\n

\n

“The Advisory Commission may decide to invite major institutional donors to attend its meetings” <\/p><\/div>\n

\n

was deleted;<\/p><\/div>\n

\n

 (b)   After subparagraph (c), an additional subparagraph was inserted, reading: <\/p><\/div>\n

\n

 “(d)   To invite the European Community to attend the meetings of the Advisory Commission” <\/p><\/div>\n

\n

and the remaining subparagraph was renumbered accordingly.<\/p><\/div>\n

\n

20.   At the same meeting, the Chairman orally revised subparagraph (b) of the revised draft decision, by inserting the word “Australia” before the word “Canada”. <\/p><\/div>\n

\n

21.   Also at the same meeting, the Committee adopted draft decision A\/C.4\/60\/L.18\/Rev.1, as orally revised, without a vote (see para. 23). <\/p><\/div>\n

  III.   Recommendations of the Special Political and Decolonization Committee (Fourth Committee) <\/strong><\/p><\/div>\n

22.   The Special Political and Decolonization Committee (Fourth Committee) recommends to the General Assembly the adoption of the following draft resolutions: <\/p><\/div>\n

 Recalling also <\/i>its resolution 302 (IV) of 8 December 1949, by which, inter alia, it established the United Nations Relief and Works Agency for Palestine Refugees in the Near East, <\/p><\/div>\n

\n

 <\/span>Recalling further <\/i><\/span>relevant Security Council resolutions,<\/span> <\/span><\/p><\/div>\n

\n

  Aware <\/i>of the fact that, for more than five decades, the Palestine refugees have suffered from the loss of their homes, lands and means of livelihood, <\/p><\/div>\n

\n

 Affirming <\/i>the imperative of resolving the problem of the Palestine refugees for the achievement of justice and for the achievement of lasting peace in the region, <\/p><\/div>\n

\n

 Acknowledging <\/i>the essential role that the United Nations Relief and Works Agency for Palestine Refugees in the Near East has played for more than fifty-five years since its establishment in ameliorating the plight of the Palestine refugees in the fields of education, health and relief and social services, <\/p><\/div>\n

\n

 <\/span>Taking note <\/i><\/span>of the report of the Commissioner-General of the United Nations Relief and Works Agency for Palestine Refugees in the Near East covering the period from 1 July 2004 to 30 June 2005, <\/span>4<\/u><\/sup><\/a> <\/span><\/p><\/div>\n

\n

 Aware <\/i>of the continuing needs of the Palestine refugees throughout all the fields of operation, namely Jordan, Lebanon, the Syrian Arab Republic and the Occupied Palestinian Territory, <\/p><\/div>\n

\n

 Expressing grave concern <\/i>at the especially difficult situation of the Palestine refugees under occupation, including with regard to their safety, well-being and living conditions, <\/p><\/div>\n

\n

 <\/span>Noting <\/i><\/span>the signing of the Declaration of Principles on Interim Self-Government Arrangements on 13 September 1993 by the Government of Israel and the Palestine Liberation Organization <\/span>5<\/u><\/sup><\/a> <\/span>and the subsequent implementation agreements,<\/span><\/p><\/div>\n

\n

 Aware <\/i>of the important role to be played in the peace process by the Multilateral Working Group on Refugees of the Middle East peace process, <\/p><\/div>\n

\n

 1.  Notes with regret <\/i>that repatriation or compensation of the refugees, as provided for in paragraph 11 of General Assembly resolution 194 (III), has not yet been effected and that, therefore, the situation of the Palestine refugees continues to be a matter of grave concern; <\/p><\/div>\n

\n

 2.  Also notes with regret <\/i>that the United Nations Conciliation Commission for Palestine has been unable to find a means of achieving progress in the implementation of paragraph 11 of General Assembly resolution 194 (III), and reiterates its request to the Conciliation Commission to exert continued efforts towards the implementation of that paragraph and to report to the Assembly as appropriate, but no later than 1 September 2006; <\/p><\/div>\n

\n

 3.  Affirms <\/i>the necessity for the continuation of the work of the United Nations Relief and Works Agency for Palestine Refugees in the Near East and the importance of its operation and its services for the well-being of the Palestine refugees and for the stability of the region, pending the resolution of the question of the Palestine refugees; <\/p><\/div>\n

\n

 4.  Calls upon <\/i>all donors to continue to make the most generous efforts possible to meet the anticipated needs of the Agency, including those mentioned in recent emergency appeals. <\/p><\/div>\n

 Concerned <\/i>about the continuing human suffering resulting from the June 1967 and subsequent hostilities, <\/p><\/div>\n

\n

 <\/span>Taking note <\/i><\/span>of the relevant provisions of the Declaration of Principles on Interim Self-Government Arrangements of 1993 <\/span>8<\/u><\/sup><\/a> <\/span>with regard to the modalities for the admission of persons displaced in 1967, and concerned that the process agreed upon has not yet been effected, <\/span><\/p><\/div>\n

\n

 1.  Reaffirms <\/i>the right of all persons displaced as a result of the June 1967 and subsequent hostilities to return to their homes or former places of residence in the territories occupied by Israel since 1967; <\/p><\/div>\n

\n

 2.  <\/span>Expresses deep concern <\/i><\/span>that the mechanism agreed upon by the parties in article XII of the Declaration of Principles on Interim Self-Government Arrangements of 1993 <\/span>3<\/u><\/sup><\/a> on the return of displaced persons has not been complied with, and stresses the necessity for an accelerated return of displaced persons; <\/span><\/p><\/div>\n

\n

 3.  Endorses<\/i> , in the meanwhile, the efforts of the Commissioner-General of the United Nations Relief and Works Agency for Palestine Refugees in the Near East to continue to provide humanitarian assistance, as far as practicable, on an emergency basis, and as a temporary measure, to persons in the area who are currently displaced and in serious need of continued assistance as a result of the June 1967 and subsequent hostilities; <\/p><\/div>\n

\n

 4.  Strongly appeals <\/i>to all Governments and to organizations and individuals to contribute generously to the Agency and to the other intergovernmental and non-governmental organizations concerned for the above-mentioned purposes; <\/p><\/div>\n

 5.  Requests <\/i>the Secretary-General, after consulting with the Commissioner-General, to report to the General Assembly before its sixty-first session on the progress made with regard to the implementation of the present resolution.<\/p><\/div>\n

  Deeply concerned <\/i>about the critical financial situation of the Agency and its effect on the provision of necessary Agency services to the Palestine refugees, including its emergency-related and development programmes, <\/p><\/div>\n

 <\/span>Recalling <\/i><\/span>Articles 100, 104 and 105 of the Charter of the United Nations and the Convention on the Privileges and Immunities of the United Nations, <\/span>11<\/u><\/sup><\/a> <\/sup><\/span><\/p><\/div>\n

 Gravely concerned <\/i>about the extremely difficult living conditions being faced by the Palestine refugees in the Occupied Palestinian Territory, including East Jerusalem, including in the Rafah and Jabaliya refugee camps, resulting, inter alia, from loss of life and injury, extensive destruction and damage to their shelters and properties, and displacement, <\/p><\/div>\n

\n

 Aware <\/i>of the extraordinary efforts being undertaken by the Agency for the repair or rebuilding of thousands of damaged or destroyed refugee shelters, <\/p><\/div>\n

\n

 Aware also <\/i>of the valuable work done by the refugee affairs officers of the Agency in providing protection to the Palestinian people, in particular Palestine refugees, <\/p><\/div>\n

\n

 Gravely concerned <\/i>about the endangerment of the safety of the Agency’s staff and about the damage caused to the facilities of the Agency as a result of Israeli military operations during the reporting period, <\/p><\/div>\n

\n

 Deploring <\/i>the killing of twelve Agency staff members by the Israeli occupying forces since September 2000, <\/p><\/div>\n

\n

 Deploring also <\/i>the killing and wounding of children in the Agency’s schools by the Israeli occupying forces, <\/p><\/div>\n

\n

 Expressing deep concern <\/i>about the policies of closure and severe restrictions, including the curfews, that continue to be imposed on the movement of persons and goods throughout the Occupied Palestinian Territory, including East Jerusalem, which have had a grave impact on the socio-economic situation of the Palestine refugees and have greatly contributed to the dire humanitarian crisis facing the Palestinian people, <\/p><\/div>\n

\n

 Deeply concerned <\/i>about the continuing imposition of restrictions on the freedom of movement of the Agency’s staff, vehicles and goods, and the harassment and intimidation of the Agency’s staff, which undermine and obstruct the work of the Agency, including its ability to provide its essential services, notably its education, health and relief and social services, <\/p><\/div>\n

\n

 <\/span>Recalling <\/i><\/span>the signing, on 13 September 1993, of the Declaration of Principles on Interim Self-Government Arrangements by the Government of Israel and the Palestine Liberation Organization <\/span>14<\/u><\/sup><\/a> <\/sup><\/span>and the subsequent implementation agreements,<\/span><\/p><\/div>\n

\n

 Aware <\/i>of the agreement between the Agency and the Government of Israel,<\/p><\/div>\n

\n

 <\/span> Taking note <\/i><\/span>of the agreement reached on 24 June 1994, embodied in an exchange of letters between the Agency and the Palestine Liberation Organization, <\/span>15<\/u><\/sup><\/a> <\/sup><\/span><\/p><\/div>\n

 Recalling <\/i>the Geneva Conference convened by the United Nations Relief and Works Agency for Palestine Refugees in the Near East and the Swiss Agency for Development and Cooperation on 7 and 8 June 2004 to increase support for the United Nations Relief and Works Agency, <\/p><\/div>\n

\n

 1.  Expresses its appreciation <\/i>to the Commissioner-General of the United Nations Relief and Works Agency for Palestine Refugees in the Near East, as well as to all of the staff of the Agency, for their tireless efforts and valuable work, particularly in the light of the difficult conditions during the past year; <\/p><\/div>\n

\n

 2.  Also expresses its appreciation <\/i>to the Advisory Commission of the Agency, and requests it to continue its efforts and to keep the General Assembly informed of its activities; <\/p><\/div>\n

\n

 3.  <\/span>Takes note with appreciation <\/i><\/span>of the report of the Working Group on the Financing of the United Nations Relief and Works Agency for Palestine Refugees in the Near East, <\/span>16<\/u><\/sup><\/a> <\/sup><\/span>and the efforts of the Working Group to assist in ensuring the financial security of the Agency, and requests the Secretary-General to provide the necessary services and assistance to the Working Group for the conduct of its work; <\/span><\/p><\/div>\n

\n

 4.  <\/span>Commends <\/i><\/span>the continuing efforts of the Commissioner-General to increase the budgetary transparency and efficiency of the Agency, as reflected in the Agency’s programme budget for the biennium 2006-2007; <\/span>17<\/u><\/sup><\/a> <\/sup><\/span><\/p><\/div>\n

\n

 5.  Acknowledges <\/i>the important support provided by the host Governments to the Agency in the discharge of its duties; <\/p><\/div>\n

\n

 6.  <\/span>Encourages <\/i><\/span>the Agency’s further consideration of the needs and rights of children in its operations in accordance with the Convention on the Rights of the Child; <\/span>18<\/u><\/sup><\/a> <\/sup><\/span><\/p><\/div>\n

 7.   Expresses concern <\/i>about the temporary relocation of the headquarters international staff of the Agency from Gaza City and the disruption of operations at the headquarters; <\/p><\/div>\n

 <\/span>Taking note <\/i><\/span>of the report of the Secretary-General submitted in pursuance of resolution 59\/120 of 10 December 2004, <\/span>19<\/u><\/sup><\/a> <\/sup><\/span><\/p><\/div>\n

 <\/span>Noting <\/i><\/span>the completion of the programme of identification and evaluation of Arab property, as announced by the Conciliation Commission in its twenty-second progress report, <\/span>22<\/u><\/sup><\/a> <\/sup><\/span>and the fact that the Land Office had a schedule of Arab owners and file of documents defining the location, area and other particulars of Arab property, <\/span><\/p><\/div>\n

\n

 Expressing its appreciation <\/i>for the work done to preserve and modernize the existing records, including the land records, of the Conciliation Commission and the importance of such records for a just resolution of the plight of the Palestine refugees in conformity with resolution 194 (III), <\/p><\/div>\n

\n

 <\/span>Recalling <\/i><\/span>that, in the framework of the Middle East peace process, the Palestine Liberation Organization and the Government of Israel agreed, in the Declaration of Principles on Interim Self-Government Arrangements of 13 September 1993, <\/span>23<\/u><\/sup><\/a> <\/sup><\/span>to commence negotiations on permanent status issues, including the important issue of the refugees, <\/span><\/p><\/div>\n

\n

 1.  Reaffirms <\/i>that the Palestine refugees are entitled to their property and to the income derived therefrom, in conformity with the principles of equity and justice; <\/p><\/div>\n

\n

 2.  Requests <\/i>the Secretary-General to take all appropriate steps, in consultation with the United Nations Conciliation Commission for Palestine, for the protection of Arab property, assets and property rights in Israel; <\/p><\/div>\n

\n

 3.  Calls once again upon <\/i>Israel to render all facilities and assistance to the Secretary-General in the implementation of the present resolution; <\/p><\/div>\n

\n

 4.  Calls upon <\/i>all the parties concerned to provide the Secretary-General with any pertinent information in their possession concerning Arab property, assets and property rights in Israel that would assist him in the implementation of the present resolution; <\/p><\/div>\n

\n

 5.  Urges <\/i>the Palestinian and Israeli sides, as agreed between them, to deal with the important issue of Palestine refugees’ properties and their revenues within the framework of the final status negotiations of the Middle East peace process; <\/p><\/div>\n

 6.  Requests <\/i>the Secretary-General to report to the General Assembly at its sixty-first session on the implementation of the present resolution. <\/p><\/div>\n

 (a)   That those States that are currently members of the Advisory Commission on the United Nations Relief and Works Agency for Palestine Refugees in the Near East shall continue as such; <\/p><\/div>\n

 (b)   To invite Australia, Canada, Denmark, Germany, Italy, the Netherlands, Norway, Saudi Arabia, Spain, Sweden and Switzerland, whose contributions to all United Nations Relief and Works Agency for Palestine Refugees in the Near East activities have exceeded an annual average of 5 million Unites States dollars over the past three years, including the current year, to become members of the Advisory Commission; <\/p><\/div>\n

 (c)   To invite Palestine to attend and fully participate in the meetings of the Advisory Commission as an observer; <\/p><\/div>\n

 (d)   To invite the European Community to attend the meetings of the Advisory Commission; <\/p><\/div>\n
