Introductory Note<\/strong><\/p><\/div>\n

\n

1. The introductory note to the Dossier is divided into three parts. The first part sets out<\/p><\/div>\n

\n

the General Assembly resolution requesting the Court to render an advisory opinion. The<\/p><\/div>\n

\n

second provides a brief background of the events that led to the adoption by the General<\/p><\/div>\n

\n

Assembly of a request for an advisory opinion. The third describes the framework of the<\/p><\/div>\n

\n

Dossier with emphasis on the presentation structure of relevant materials in the Dossier.<\/p><\/div>\n

The Request<\/strong><\/p><\/div>\n

\n

2. On 8 December 2003, the General Assembly, at its resumed Tenth Emergency Special<\/p><\/div>\n

\n

Session, adopted under agenda item 5, resolution ES-10\/14 entitled “Illegal Israeli Actions in<\/i><\/p><\/div>\n

\n

Occupied East Jerusalem and the rest of the Occupied Palestinian Territory<\/i>”. The full text of<\/p><\/div>\n

\n

the resolution containing the request (A\/Res\/ES-10\/14, Dossier no. 2) reads as follows:<\/p><\/div>\n

<\/p>\n

\n

“The General Assembly,<\/i><\/p><\/div>\n

<\/p>\n

\n

Reaffirming <\/i>its resolution ES-10\/13 of 21 October 2003,<\/p><\/div>\n

\n

Guided <\/i>by the principles of the Charter of the United Nations,<\/p><\/div>\n

\n

Aware <\/i>of the established principle of international law on the inadmissibility of<\/p><\/div>\n

\n

the acquisition of territory by force,<\/p><\/div>\n

<\/p>\n

\n

Aware also <\/i>that developing friendly relations among nations based on respect<\/p><\/div>\n

\n

for the principle of equal rights and self-determination of peoples is among the<\/p><\/div>\n

\n

purposes and principles of the Charter of the United Nations,<\/p><\/div>\n

Recalling <\/i>the Regulations annexed to the Hague Convention Respecting the<\/p><\/div>\n

\n

Laws and Customs of War on Land of 1907,<\/span>3<\/sup><\/span><\/p><\/div>\n

<\/p>\n

\n

Welcoming <\/i>the convening of the Conference of High Contracting Parties to the<\/p><\/div>\n

\n

Fourth Geneva Convention on measures to enforce the Convention in the Occupied<\/p><\/div>\n

\n

Palestinian Territory, including Jerusalem, at Geneva on 15 July 1999,<\/p><\/div>\n

\n

Expressing its support <\/i>for the declaration adopted by the reconvened<\/p><\/div>\n

\n

Conference of High Contracting Parties to the Fourth Geneva Convention at Geneva on<\/p><\/div>\n

\n

5 December 2001,<\/p><\/div>\n

<\/p>\n

\n

Recalling in particular <\/i>relevant United Nations resolutions affirming that Israeli<\/p><\/div>\n

\n

settlements in the Occupied Palestinian Territory, including East Jerusalem, are illegal<\/p><\/div>\n

\n

and an obstacle to peace and to economic and social development as well as those<\/p><\/div>\n

\n

demanding the complete cessation of settlement activities,<\/p><\/div>\n

<\/p>\n

\n

Recalling <\/i>relevant United Nations resolutions affirming that actions taken by<\/p><\/div>\n

\n

Israel, the occupying Power, to change the status and demographic composition of<\/p><\/div>\n

\n

Occupied East Jerusalem have no legal validity and are null and void,<\/p><\/div>\n

\n

Noting <\/i>the agreements reached between the Government of Israel and the<\/p><\/div>\n

\n

Palestine Liberation Organization in the context of the Middle East peace process,<\/p><\/div>\n

<\/p>\n

\n

Gravely concerned <\/i>at the commencement and continuation of construction by<\/p><\/div>\n

\n

Israel, the occupying Power, of a wall in the Occupied Palestinian Territory, including<\/p><\/div>\n

\n

in and around East Jerusalem, which is in departure from the Armistice Line of 1949<\/p><\/div>\n

\n

(Green Line) and which has involved the confiscation and destruction of Palestinian<\/p><\/div>\n

\n

land and resources, the disruption of the lives of thousands of protected civilians and<\/p><\/div>\n

\n

the de facto annexation of large areas of territory, and underlining the unanimous<\/p><\/div>\n

\n

opposition by the international community to the construction of that wall,<\/p><\/div>\n

<\/p>\n

\n

Gravely concerned also <\/i>at the even more devastating impact of the projected<\/p><\/div>\n

\n

parts of the wall on the Palestinian civilian population and on the prospects for solving<\/p><\/div>\n

\n

the Palestinian-Israeli conflict and establishing peace in the region,<\/p><\/div>\n

<\/p>\n

\n

Welcoming <\/i>the report of 8 September 2003 of the Special Rapporteur of the<\/p><\/div>\n

\n

Commission on Human Rights on the situation of human rights in the Palestinian<\/p><\/div>\n

\n

territories occupied by Israel since 1967,<\/span>4<\/sup><\/span> <\/span>in particular the section regarding the wall,<\/span><\/p><\/div>\n

<\/p>\n

\n

Affirming <\/i>the necessity of ending the conflict on the basis of the two-State<\/p><\/div>\n

\n

solution of Israel and Palestine living side by side in peace and security based on the<\/p><\/div>\n

\n

Armistice Line of 1949, in accordance with relevant Security Council and General<\/p><\/div>\n

\n

Assembly resolutions,<\/p><\/div>\n

<\/p>\n

\n

Having received with appreciation <\/i>the report of the Secretary-General<\/p><\/div>\n

\n

submitted in accordance with resolution ES-10\/13,<\/span>5<\/sup><\/span><\/p><\/div>\n

<\/p>\n

\n

Bearing in mind <\/i>that the passage of time further compounds the difficulties on<\/p><\/div>\n

\n

the ground, as Israel, the occupying Power, continues to refuse to comply with<\/p><\/div>\n

\n

international law vis-à-vis its construction of the above-mentioned wall, with all its<\/p><\/div>\n

\n

detrimental implications and consequences,<\/p><\/div>\n

<\/p>\n

\n

Decides<\/i>, in accordance with Article 96 of the Charter of the United Nations, to<\/p><\/div>\n

\n

request the International Court of Justice, pursuant to article 65 of the Statute of the<\/p><\/div>\n

\n

Court, to urgently render an advisory opinion on the following question:<\/p><\/div>\n

<\/p>\n

\n

What are the legal consequences arising from the construction of the<\/p><\/div>\n

\n

wall being built by Israel, the occupying Power, in the Occupied Palestinian<\/p><\/div>\n

\n

Territory, including in and around East Jerusalem, as described in the report of<\/p><\/div>\n

\n

the Secretary-General, considering the rules and principles of international law,<\/p><\/div>\n

\n

including the Fourth Geneva Convention of 1949, and relevant Security Council<\/p><\/div>\n

\n

and General Assembly resolutions?”<\/p><\/div>\n

Background of the events that led to the request by the General Assembly for the<\/strong><\/p><\/div>\n

\n

advisory opinion<\/strong><\/p><\/div>\n

<\/p>\n

\n

3. On 14 April 2002 the Government of Israel decided to build a system of fences, walls,<\/p><\/div>\n

\n

ditches and barriers in the West Bank. Israel then proceeded to erect what is hereinafter<\/p><\/div>\n

\n

referred to as “the Barrier”.<\/p><\/div>\n

<\/p>\n

\n

4. In his letter dated 9 October 2003 addressed to the President of the Security Council<\/p><\/div>\n

\n

(S\/2003\/973; Dossier, no. 73), the Permanent Representative of the Syrian Arab Republic and<\/p><\/div>\n

\n

the Chair of the Arab Group, requested, on behalf of the States Members of the League of Arab<\/p><\/div>\n

\n

States, an immediate meeting of the Security Council to consider the “[…] grave and ongoing<\/p><\/div>\n

\n

Israeli violations of international law, including international humanitarian law, and to take the<\/p><\/div>\n

\n

necessary measures in this regard”. The Chair specifically asked the Security Council to<\/p><\/div>\n

\n

address (i) “the decision by Israel to proceed with the construction of its expansionist conquest<\/p><\/div>\n

\n

wall in the Occupied Palestinian Territory, including East Jerusalem” and (ii) “the continuing<\/p><\/div>\n

\n

illegal Israeli settlement activities aimed at colonizing the Palestinian land” and had, as an<\/p><\/div>\n

\n

annex, a draft resolution for consideration by the Council. In his letter, the Chair of the Arab<\/p><\/div>\n

\n

Group referred to the letters dated 1 October 2003 (A\/58\/399-S\/2003\/929; Dossier no. 71) and<\/p><\/div>\n

\n

3 October 2003 (A\/58\/411-S\/2003\/938; Dossier no. 72) from the Permanent Observer of<\/p><\/div>\n

\n

Palestine, which referred, inter alia<\/i>, to the construction of the Barrier by Israel and its “illegal<\/p><\/div>\n

\n

settlement activities”, respectively.<\/p><\/div>\n

<\/p>\n

\n

5. The Security Council held its 4841<\/span>st <\/span>and 4842<\/span>nd <\/span>meetings, on 14 October 2003, to<\/span><\/p><\/div>\n

\n

consider the item entitled “The situation in the Middle East, including the Palestine question<\/i>”<\/p><\/div>\n

\n

(S\/PV.4841 and S\/PV.4842; Dossier nos. 44, 45). The Council had before it a draft resolution<\/p><\/div>\n

\n

(S\/2003\/980; Dossier no. 84) submitted for its consideration which read as follows:<\/p><\/div>\n

<\/p>\n

\n

“The Security Council<\/i>,<\/p><\/div>\n

<\/p>\n

\n

Recalling <\/i>its resolutions 242 (1967) of 22 November 1967, 267 (1969) of 3 July<\/p><\/div>\n

\n

1969, 298 (1971) of 25 September 1971, 446 (1979) of 22 March 1979, 452 (1979) of<\/p><\/div>\n

\n

20 July 1979, 465 (1980) of 1 March 1980, 476 (1980) of 30 June 1980, 478 (1980) of<\/p><\/div>\n

\n

20 August 1980, 904 (1994) of 18 March 1994, 1073 (1996) of 28 September 1996 and<\/p><\/div>\n

\n

Reaffirming <\/i>the principle of the inadmissibility of the acquisition of territory by<\/p><\/div>\n

\n

force,<\/p><\/div>\n

<\/p>\n

\n

Reaffirming <\/i>its vision of a region where two States, Israel and Palestine, live<\/p><\/div>\n

\n

side by side within secure and recognized borders,<\/p><\/div>\n

<\/p>\n

\n

Condemning <\/i>all acts of violence, terror and destruction,<\/p><\/div>\n

<\/p>\n

\n

Stressing <\/i>the urgency of ending the current violent situation on the ground, the<\/p><\/div>\n

\n

need to end the occupation that began in 1967 and the need to achieve peace based on<\/p><\/div>\n

\n

the vision of two States mentioned above,<\/p><\/div>\n

<\/p>\n

\n

Reiterating <\/i>its call upon Israel, the occupying Power, to fully and effectively<\/p><\/div>\n

\n

respect the Fourth Geneva Convention of 1949,<\/p><\/div>\n

<\/p>\n

\n

Reiterating <\/i>its opposition to settlement activities in the Occupied Territories and<\/p><\/div>\n

\n

to any activities involving the confiscation of land, disruption of the livelihood of<\/p><\/div>\n

\n

protected persons and the de facto annexation of land,<\/p><\/div>\n

<\/p>\n

\n

1. Decides <\/i>that the construction by Israel, the occupying Power, of a wall in<\/p><\/div>\n

\n

the Occupied Territories departing from the armistice line of 1949 is illegal under<\/p><\/div>\n

\n

relevant provisions of international law and must be ceased and reversed;<\/p><\/div>\n

<\/p>\n

\n

2. Requests <\/i>the Secretary-General to report on the compliance with this<\/p><\/div>\n

\n

resolution periodically, with the first report to be submitted within one month;<\/p><\/div>\n

<\/p>\n

\n

3. Decides <\/i>to remain seized of the matter.”<\/p><\/div>\n

<\/p>\n

\n

6. At its meetings on 14 October 2003, the Security Council held an open debate on the<\/p><\/div>\n

\n

item, at the end of which the draft resolution referred to in paragraph 5 was put to a vote, but<\/p><\/div>\n

\n

was not adopted owing to the negative vote of a permanent member of the Security Council.<\/p><\/div>\n

\n

The result of the vote was as follows: 10 in favour, 1 against and 4 abstentions (<\/span>S\/PV.4841<\/span> and<\/span><\/p><\/div>\n

\n

S\/PV.4842; Dossier nos. 44, 45).<\/strong><\/p><\/div>\n

<\/p>\n

\n

7. On 15 October 2003, the Chair of the Arab Group, on behalf of the States members of<\/p><\/div>\n

\n

the League of Arab States, requested the resumption of the Tenth Emergency Special Session<\/p><\/div>\n

\n

of the General Assembly, to consider agenda item 5, entitled “Illegal Israeli actions in<\/i><\/p><\/div>\n

\n

Occupied East Jerusalem and the rest of the Occupied Palestinian Territory<\/i>” (A\/ES-10\/242;<\/p><\/div>\n

\n

Dossier no. 74). This request was supported by the Non-Aligned Movement (A\/ES-10\/243;<\/p><\/div>\n

\n

Dossier no. 75) and the Organization of the Islamic Conference Group (A\/ES-10\/244; Dossier<\/p><\/div>\n

\n

no. 76).<\/p><\/div>\n

<\/p>\n

\n

8. The General Assembly resumed its work on 20 October 2003. At its 21<\/span>st <\/span>and 22<\/span>nd<\/span><\/p><\/div>\n

\n

meetings, on 20 and 21 October 2003, respectively, the Assembly had before it three draft<\/p><\/div>\n

\n

resolutions (A\/ES-10\/L.13, A\/ES-10\/L.14 and A\/ES-10\/L.15 ; Dossier nos. 79, 80, 78). At its<\/p><\/div>\n

\n

22<\/span>nd <\/span>meeting, on 21 October, the Assembly adopted resolution ES-10\/13 (Dossier no. 14) by<\/span><\/p><\/div>\n

\n

which it, inter alia<\/i>, demanded that “Israel stop and reverse the construction of the wall in the<\/p><\/div>\n

\n

Occupied Palestinian Territory, including in and around East Jerusalem, which is in departure<\/p><\/div>\n

\n

of the Armistice Line of 1949 and is in contradiction to relevant provisions of international<\/p><\/div>\n

\n

law” (operative paragraph 1) and requested “the Secretary-General to report on compliance<\/p><\/div>\n

\n

with the present resolution periodically, with the first report on compliance with paragraph 1<\/p><\/div>\n

\n

above to be submitted within one month and upon receipt of which further actions should be<\/p><\/div>\n

\n

considered, if necessary, within the United Nations system” (operative paragraph 3).<\/p><\/div>\n

\n

Resolution ES-10\/13 was adopted by a vote of 144 in favour and 4 against, with 12 abstentions<\/p><\/div>\n

\n

(A\/ES-10\/PV.21 and A\/ES-10\/PV.22; Dossier nos. 40, 41).<\/p><\/div>\n

<\/p>\n

\n

9. In furtherance of that resolution, the report of the Secretary-General on the matter was<\/p><\/div>\n

\n

issued on 24 November 2003 as document A\/ES-10\/248 (Dossier no.52).<\/p><\/div>\n

<\/p>\n

\n

10. By a letter dated 1 December 2003, the Chair of the Arab Group, on behalf of the States<\/p><\/div>\n

\n

members of the League of Arab States and pursuant to paragraph 4 of General Assembly<\/p><\/div>\n

\n

resolution ES-10\/13 of 21 October 2003, requested the resumption of the Tenth Emergency<\/p><\/div>\n

\n

Special Session of the General Assembly “in order to address the issue of the expansionist wall<\/p><\/div>\n

\n

being constructed by Israel, the occupying Power, in the Occupied Palestinian Territory,<\/p><\/div>\n

\n

including East Jerusalem, following the issuance of the report of the Secretary General dated<\/p><\/div>\n

\n

24 November 2003” (A\/ES-10\/249; Dossier no.77).<\/p><\/div>\n

<\/p>\n

\n

11. The General Assembly resumed its work on 8 December 2003. At its 23<\/span>rd <\/span>meeting, on 8<\/span><\/p><\/div>\n

\n

December, the Assembly had before it the report of the Secretary-General (A\/ES-10\/248), draft<\/p><\/div>\n

\n

resolution A\/ES-10\/L.16 and draft decision A\/ES-10\/L.17 and Add.1. (Dossier nos. 81, 82, 83).<\/p><\/div>\n

\n

At its 23<\/span>rd <\/span>meeting, on 8 December, the Assembly adopted resolution ES-10\/14 (Dossier no. 2)<\/span><\/p><\/div>\n

\n

requesting the International Court of Justice to urgently render an advisory opinion on the<\/p><\/div>\n

\n

question referred to at the end of the quotation contained in paragraph 2 above. Resolution ES-<\/p><\/div>\n

\n

10\/14 was adopted by 90 votes in favour and 8 against, with 74 abstentions (A\/ES-10\/PV.23;<\/p><\/div>\n

\n

Dossier no. 42).<\/p><\/div>\n

<\/p>\n

\n

Framework of the Dossier<\/strong><\/p><\/div>\n

<\/p>\n

\n

12. The Dossier, prepared according to Article 65, paragraph 2 of the Statute of the Court,<\/p><\/div>\n

\n

contains materials intended to throw light on the question on which the advisory opinion of the<\/p><\/div>\n

\n

Court is requested.<\/p><\/div>\n

<\/p>\n

\n

13. All materials referred to in the “Contents of the Dossier” are provided in the Dossier<\/p><\/div>\n

\n

Annex. The relevant materials cited throughout the Dossier are numbered consecutively (e.g.<\/p><\/div>\n

\n

1, 2, 3…) and these numbers correspond with the Dossier numbers (e.g. Dossier no. 1, 2, 3…).<\/p><\/div>\n
