The United Nations provides these documents only as a convenience for reference purposes, and the inclusion of a document does not imply the endorsement of its content by the United Nations.<\/strong><\/span><\/p>\n<p>24 April 2025<\/p>\n<ul>\n<li><em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b5913d.pdf\" target=\"_blank\" rel=\"noopener\">Judgment on the appeal of the State of Israel against Pre-Trial Chamber I\u2019s \u201cDecision on Israel\u2019s challenge to the jurisdiction of the Court pursuant to article 19(2) of the Rome Statute\u201d<\/a><\/em><\/li>\n<li><em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b5913e.pdf\" target=\"_blank\" rel=\"noopener\">Decision on the admissibility of the appeal of the State of Israel against Pre-Trial Chamber I\u2019s \u201cDecision on Israel\u2019s request for an order to the Prosecution to give an Article 18(1) notice\u201d<\/a><\/em><\/li>\n<li><em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b59141.pdf\" target=\"_blank\" rel=\"noopener\">Dissenting Opinion of Judge Luz Del Carmen \u00a0Ib\u00e1\u00f1ez Carranza\u00a0<\/a><\/em><\/li>\n<li><em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b59142.pdf\" target=\"_blank\" rel=\"noopener\">Dissenting Opinion of Judge Solomy Balungi Bossa\u00a0<\/a><\/em><\/li>\n<\/ul>\n<p class=\"mt-4\">Today, 24 April 2025, the Appeals Chamber of the International Criminal Court (\u201cCourt\u201d) issued its<em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b5913d.pdf\" target=\"_blank\" rel=\"noopener\">\u00a0judgment on the appeal<\/a><\/em>\u00a0filed by the State of Israel (\u201cIsrael\u201d) against the decision of Pre-Trial Chamber I on Israel\u2019s challenge to the jurisdiction of the Court pursuant to article 19(2) of the Statute (\u201cImpugned Decision\u201d). The Pre-Trial Chamber\u00a0<em><a href=\"https:\/\/www.un.org\/unispal\/document\/icc-arrest-warrant-netanyahu-21nov24\/\" target=\"_blank\" rel=\"noopener\">had rejected<\/a><\/em>\u00a0Israel\u2019s challenge to the jurisdiction of the Court as premature. Accordingly, the Appeals Chamber\u00a0<em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b5913d.pdf\" target=\"_blank\" rel=\"noopener\">concluded<\/a><\/em>\u00a0that the Impugned Decision consists of or is based on a ruling on the jurisdiction of the Court and, as a result, it considered the appeal to be admissible under article 82(1)(a) of the Statute.<\/p>\n<p>On the merits of the appeal, the Appeals Chamber concluded that the Pre-Trial Chamber committed an error of law by failing to sufficiently address Israel\u2019s argument that it was entitled to make a jurisdictional challenge under article 19(2)(c) of the Statute. The Appeals Chamber therefore reversed the Impugned Decision and remanded the matter to the Pre-Trial Chamber for a new ruling on the substance of Israel\u2019s challenge to the jurisdiction of the Court.<\/p>\n<p>In light of the above, the Appeals Chamber dismissed, as moot, Israel\u2019s request for suspensive effect of two arrest warrants issued after the Impugned Decision and \u201cany other legal acts taken by the Court based thereon\u201d.<\/p>\n<p>In addition, today the Appeals Chamber, by majority,\u00a0<em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b5913e.pdf\" target=\"_blank\" rel=\"noopener\">dismissed<\/a><\/em>\u00a0Israel\u2019s appeal against Pre-Trial Chamber I\u2019s decision rejecting Israel\u2019s request for an order to the Prosecutor to issue a new notice pursuant to article 18(1) of the Statute. The Appeals Chamber, by majority,\u00a0<em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b59141.pdf\" target=\"_blank\" rel=\"noopener\">Judge Luz del Carmen Ib\u00e1\u00f1ez Carranza<\/a><\/em>\u00a0and\u00a0<em><a href=\"https:\/\/www.un.org\/unispal\/wp-content\/uploads\/2025\/05\/0902ebd180b59142.pdf\" target=\"_blank\" rel=\"noopener\">Judge Solomy Balungi Bossa<\/a><\/em>\u00a0dissenting, found the appeal to be inadmissible, considering that the Pre-Trial Chamber\u2019s decision was not a decision with respect to admissibility pursuant to article 82(1)(a) of the Statute.<\/p>\n<p>The Appeals Chamber deciding on these two appeals is composed of Judge Tomoko Akane, Presiding, Judge Luz del Carmen Ib\u00e1\u00f1ez Carranza, Judge Solomy Balungi Bossa, Judge Gocha Lordkipanidze, and Judge Erdenebalsuren Damdin.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; This is a non-United Nations document.
