  {"id":315659,"date":"2026-03-02T10:05:49","date_gmt":"2026-03-02T15:05:49","guid":{"rendered":"https:\/\/www.un.org\/unispal\/?post_type=document&#038;p=315659"},"modified":"2026-03-03T10:10:56","modified_gmt":"2026-03-03T15:10:56","slug":"un-experts-condemn-board-of-peace-2mar26","status":"publish","type":"document","link":"https:\/\/www.un.org\/unispal\/document\/un-experts-condemn-board-of-peace-2mar26\/","title":{"rendered":"UN experts condemn \u2018Board of Peace\u2019, call for a reparative, rights-based approach to reconstruction in Gaza"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>2 March 2026<\/p>\n<div class=\"node-news__body\">\n<div class=\"wysiwyg-content field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p class=\"text--body-copy--gray without-margins\"><strong>GENEVA<\/strong>\u00a0\u2013 The international community must ensure that any efforts to reconstruct Gaza are guided by international law and human rights norms and standards, rather than by neo-colonial interests that rest on impunity and avarice, UN experts* said today.<\/p>\n<p>\u201cThe right of Palestinians to self-determination is inalienable, it is not a conditional privilege,\u201d the experts said. \u201cDecision-making concerning Gaza\u2019s reconstruction and future should be in the hands of Palestinians, who should be able to remain and return voluntarily and in safety to their land and properties. Their right to self-determination also extends to decisions concerning the reconstruction of Gaza and the type of development they wish to pursue. Such decisions should not be imposed by foreign powers.\u201d<\/p>\n<p>\u201cLeaders must stop speculating about Gaza as a real estate paradise and see it for what it is \u2013 the war-ravaged homeland of its residents who have the right to rebuild their lives after the enormous suffering and deprivations they have endured,\u201d they said.<\/p>\n<p>According to estimates, between October 2023 and October 2025, at least 92 per cent of Gaza\u2019s housing units were either fully destroyed or damaged.<\/p>\n<p>A\u00a0<a href=\"https:\/\/www.un.org\/unispal\/document\/domicide-report-26feb26\/\" target=\"_blank\" rel=\"noopener\">new analysis<\/a>\u00a0by the Special Rapporteur on the right to adequate housing concludes that the means and ways in which Israel is committing systematic and widespread destruction of housing in Gaza, widely referred to as \u2018domicide\u2019, amounts to war crimes and has reached the threshold for crimes against humanity and genocide.<\/p>\n<p>The new analysis coincides with the launch of a set of\u00a0<a title=\"guiding-principles-reconstruction.pdf\" href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/documents\/issues\/housing\/activities\/guiding-principles-reconstruction.pdf\" target=\"_blank\" rel=\"noopener\">draft Guiding Principles on Reconstruction<\/a>\u00a0and a related\u00a0<a title=\"legal-commentary-guiding-principles-reconstruction.pdf\" href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/documents\/issues\/housing\/activities\/legal-commentary-guiding-principles-reconstruction.pdf\" target=\"_blank\" rel=\"noopener\">Legal commentary<\/a>, which stress that persons and peoples affected by conflict are entitled to a right to reconstruction and reparation to fully restore their economic, social, cultural, civil and political rights.<\/p>\n<p>\u201cMember states have a responsibility to ensure that Gaza\u2019s residents have the means and opportunity to lead and benefit from its reconstruction,\u201d the experts said. This includes ensuring the availability of funds and unimpeded entry of machinery and materials for reconstruction of housing, civilian infrastructure, public, educational and health care facilities, destroyed places of worship and objects of cultural significance.<\/p>\n<p>\u201cAs the aggressor and occupying power, this responsibility begins first and foremost with Israel \u2013 and the states that provided it with military and other support for its campaign in Gaza,\u201d the experts said. \u201cThe ceasefire must hold, the occupation must end, and there should be guarantees for non-repetition as prerequisites for any sustainable and rights-based reconstruction process.\u201d<\/p>\n<p>\u201cThe creation of the Board of Peace is an illegal and illegitimate maneuver by powerful States driven by nostalgia and avarice,\u201d they said.<\/p>\n<p>The experts warned that the establishment and endorsement of the Board of Peace by the UN Security Council Resolution 2803 is fundamentally contrary to basic principles of international law, including the right to self-determination.<\/p>\n<p>\u201cThe creation of the Board of Peace also contravenes the\u00a0<a href=\"https:\/\/www.un.org\/unispal\/icj-and-question-of-palestine\/\" target=\"_blank\" rel=\"noopener\">advisory opinion<\/a>\u00a0of the International Court of Justice of July 2024, demanding the immediate end to Israel\u2019s occupation, as also reiterated by the General Assembly in Resolution ES-10\/24,\u201d they said.<\/p>\n<p>According to the experts, the approach of the Board of Peace is the antithesis of a human rights-based approach to reconstruction and a throwback to the bygone days of colonialism.<\/p>\n<p>\u201cMember states must ensure that they do not support decisions and actions contrary to international law and that \u2018redevelopment\u2019 of Gaza does not further violate the human rights of its population.\u201d<\/p>\n<\/div>\n<\/div>\n<p><strong><a href=\"https:\/\/www.un.org\/unispal\/un-human-rights-council-and-the-question-of-palestine\/\" target=\"_blank\" rel=\"noopener\">To learn more about Special Procedures of the UN Human Rights Council and the Question of Palestine, click here to visit the dedicated webpage.<\/a><\/strong><\/p>\n<div class=\"node-news__text-block\">\n<div class=\"field field--name-field-components-list field--type-entity-reference-revisions field--label-hidden field__items\">\n<div class=\"field__item\">\n<div class=\"paragraph-bg-color paragraph para-text container paragraph--type--text-component paragraph--view-mode--default\">\n<div class=\"para-text--description wysiwyg-content\">\n<p><strong>*The experts:<\/strong><\/p>\n<ul type=\"disc\">\n<li>Balakrishnan Rajagopal,\u00a0<em><a href=\"https:\/\/www.ohchr.org\/en\/special-procedures\/sr-housing\" target=\"_blank\" rel=\"noopener\">the Special Rapporteur on adequate housing as a component of the right to an adequate standard of living, and on the right to non-discrimination in this context<\/a><\/em><\/li>\n<li>Francesca Albanese,\u00a0<em><a href=\"https:\/\/www.ohchr.org\/en\/special-procedures\/sr-palestine\" target=\"_blank\" rel=\"noopener\">the Special Rapporteur on the situation of human rights in the Palestinian territory occupied since 1967<\/a><\/em><\/li>\n<li>Cecilia M.
